ORDER OPENING THE TOWN OF MOUNTAIN VIEW PLAYGROUND TO LIMITED USE
WHEREAS, the Colorado Disaster Emergency Act, C.R.S. § 24-33.5-701, et seq. (the “Act”), provides procedures for statewide and local prevention of, preparation for, response to, and recovery from disasters and emergencies;
WHEREAS, on March 10, 2020, the Governor of Colorado declared a State of Emergency related to the presence of COVID-19 in the State. The Colorado Department of Public Health and Environment (“CDPHE”) has confirmed that COVID-19 continues to spread throughout the State of Colorado;
WHEREAS, on March 23, 2020, the Mayor of Mountain View declared a Local Disaster Emergency related to the presence of COVID-19;
WHEREAS, a significant number of Coloradans, including people of the Town, are at risk of serious health complications, including death, from COVID-19. Although most individuals who contract COVID-19 do not become seriously ill, persons with mild symptoms or asymptomatic persons with COVID-19 may place other vulnerable members of the public at significant risk;
WHEREAS, pursuant to C.R.S. § 31-15-401(1)(b), the Town has the authority to do all acts and make all regulations, which may be necessary or expedient for the promotion of health or the suppression of disease; and
WHEREAS, the Town had previously deemed it necessary to close the Town of Mountain View Playground located south of Town Hall at 4176 Benton Street, to include the children’s play area and the basketball court.
NOW, THEREFORE, IT IS HEREBY ORDERED, this 9th day of June 2020, that the Mountain View Playground located at 4176 Benton Street is now open under a maximum capacity of five (5) kids at a time. Parents supervising children in the playground area are strongly encouraged to observe a minimum six-foot distance from others and encourage their children to do the same. The basketball court shall remain closed to the public until July 31st, 2020
