THE TOWN OF MOUNTAIN VIEW TOWN COUNCIL MEETING MINUTES March 15, 2021 6:30 PM

PRESENT: Mayor Glenn Levy, Mayor Pro Tem Chelsea Steen, Councilmembers Kathleen Bailey, Mladenka “Mia” Boehrer, Sean R. Davis, Adam Ellsworth, and Melissa Jacobi. STAFF MEMBERS PRESENT: Gene Bird, Public Works Director; Steve Davis, Chief of Police OTHERS PRESENT: Shelly Clark, Professional Management Solutions, Temporary Town Clerk; Evin King; Hoffmann, Parker, Wilson & Carberry P.C., Town Attorney, Travis Reynolds, Colorado Planning Manager, SAFEbuilt; Carol Hampkamp

2) APPOINTMENT OF SHELLY CLARK AS TEMPORARY CLERK Councilmember Boehrermoved and Councilmember Steen seconded to appoint Shelly Clark of Professional Management Solutions as temporary Town Clerk from March 15th to March 22nd. Roll Call Vote: Bailey – Yes; Boehrer – Yes; Davis – Yes; Ellsworth – Yes; Jacobi – Yes; Steen – Yes. The motion passed.

3) CONSENT AGENDA Councilmember Bailey moved and Councilmember Ellsworth seconded to approve the items on the consent agenda: Meeting Minutes for February 22, 2021 Regular Meeting. Roll Call Vote: Bailey-- Yes; Boehrer--Yes; Davis--Yes; Ellsworth--Yes; Jacobi--Yes; Steen--Yes. The motion passed.

4) UNSCHEDULED PUBLIC COMMENTS-COMMENTS ARE LIMITED TO 3 MINUTESMayor Levy asked if there were any unscheduled comments from the public. There were none. Mayor Levy made a modification to the agenda by moving Item 13) Council Members’ Reports/Items before Item

5) COUNCIL MEMBERS’ REPORTS/ITEMS.
Councilmember Ellsworth shared with Council that he will be leaving the area and therefore he resigned from Council. He told the Council that it has been an honor working with them. Adam Ellsworth left the meeting at 6:42pm. Councilmember Bailey thanked Councilmember Ellsworth for his service.

6) STAFF UPDATES AND REPORTS Reports on the Town’s departmental operations were given:

Public Safety – Chief Davis referred to his report in the Agenda Packet, by pointing out to the Council that there has been an increase of suspicious incidents in the Community. The Police Department will continue to monitor this situation. Chief Davis reported to Council that Officer Fougere and Officer Ostby were both presented with permanent badges in recognition of their one-year anniversary. He updated the Council on grant activity for the Police Department: a P.O.S.T. Grant will help pay for Public Safety Leadership Courses for Sgt. Nesbitt and Sgt. Hough. A Mental Health Grant application was denied.

Public Works— Mr. Bird referred to his report in the Town Council Agenda Packet. Mr. Bird updated Council regarding a possible layout for the Town Hall expansion. Mr. Bird stated that Council member Ellsworth helped address the needed repair of 6 potholes. Several more have been identified and will be addressed. Mr. Bird stated that he has been working with Mark’s Quality Lawn & Tree on snow removal and springtime green up. Discussion on snow removal ensued. The Neighbors in Need program and the Spring Clean-up were discussed. Town Attorney— No Report

7) PUBLIC COMMENTS REGARDING CURRENT AGENDA ITEMS Mayor Levy asked if the public had any comments regarding current agenda items. There were none.

8) DISCUSSION AND POSSIBLE APPROVAL OF ORDINANCE NO. 2021-3-15A, AN ORDINANCE REPEALING AND REENACTING BY REFERENCE A ZONING DISTRICT MAP OF THE TOWN OF MOUNTAIN VIEW. Mayor Levy introduced Travis Reynolds, the Colorado Planning Manager with SAFEbuilt. Mr. Reynolds reviewed information with the Council regarding the zoning map for the Town of Mountain View. Councilmember Steen moved and Councilmember Davis seconded the approval of Ordinance No. 2021-3-15A to repeal and reenact by reference a zoning district map of the Town of Mountain View. Roll Call Vote: Bailey – Yes; Boehrer – Yes; Davis – Yes; Jacobi – Yes; Steen – Yes. The motion passed.

9) DISCUSSION AND POSSIBLE APPROVAL OF ORDINACE NO. 2021-3-15B, AN ORDINANCE AMENDING SECTION 16-1-132 OF THE MOUNTAIN VIEW MUNICIPAL CODE TO CLARIFY ADMINISTRATIVE ADJUSTMENTS. Mayor Levy reviewed the amendments to section 16-1-132 of the Mountain View Municipal Code to clarify administrative adjustments. Travis Reynolds with SAFEbuilt gave detailed information on the minimum lot size and how these adjustments will be administered. Mayor Levy asked Reynolds about the language for the word “lot” and asked if it should be changed to “parcel.” Town Attorney Evin King stated that she can change the word to “parcel.” Mayor Levy asked for approval of Ordinance No. 2021-3-15B with the amendment of the word “lot” to “parcel.” Councilmember Bailey moved and Councilmember Boehrer seconded to approve Ordinance No. 2021-3-15B as amended. Roll Call Vote: Bailey – Yes; Boehrer – Yes; Davis – Yes; Jacobi – Yes; Steen – Yes. The motion passed.

10) DISCUSSION AND POSSIBLE APPROVAL OF ORDINACE NO. 2021-3-15C, AN ORDINANCE AMENDING ARTICLE 1 OF CHAPTER 13 OF THE MOUNTAIN VIEW MUNICIPAL CODE RELATING TO TRASH CAN LIDS. Mayor Levy reviewed with Council the proposed amendments to Article 1 of Chapter 13 of the Mountain View Municipal Code relating to trash can lids. He requested that “All household” be added to the first sentence of Section 13-1-100 (a) to read: All household refuse without limitation. Councilmember Bailey moved and Councilmember Boehrer seconded the approval of Ordinance No. 2021-3-15C as amended. Roll Call Vote: Bailey – Yes; Boehrer – Yes; Davis – Yes; Jacobi – Yes; Steen – Yes. The motion passed. Mayor Levy suspended the meeting for a Break from 7:35pm to 7:51pm.

11) COUNCIL DISCUSSION TO SELECT NEW TRASH CONTAINER COLOR. Mayor Levy asked Mr. Bird to review the trash container color choices. Mr. Bird suggested that a lighter color gray, blue or tan be used for the trash containers. Mayor Levy stated his preference for tan. All members of the Council agreed with using the color tan for the new trash containers.

12) COMMITTEE UPDATES CDOC Committee—The committee referred to its report in the Town Council Agenda Packet. The Committee updated the Council on the newsletters and food drive. Sustainability Committee— The committee referred to its report in the Town Council Agenda Packet. The committee updated the Town Council on the name change for the trash clean-up event. The name has been changed to MV’s Sustainability Committee’s Beautification event. Mayor Levy suggested that the name should not include the committee’s name, but stated that the term “Town Beautification Event” would be sufficient. The committee gave updates on Earth Day and Arbor Day events. Councilmember Jacobi shared details about the virtual workshop plans.

13) MAYOR’S REPORT/ITEMS Mayor Levy reminded Town Council about the Work Session on March 22 and stated it may be changed to a Special meeting. Mayor Levy updated Council on a zoning concern that has been presented to him about townhouses and condominiums that will be discussed at a future meeting. Mayor Levy reviewed changes that will be made to the Town’s website. He also informed Council of those Town personnel who are eligible to receive the Covid vaccination.

14) MEETING TO ADJOURN Councilmember Boehrer moved and Councilmember Steen seconded to adjourn the meeting at 8:22pm. Roll Call Vote: Bailey – Yes; Boehrer – Yes; Davis – Yes; Jacobi – Yes; Steen – Yes. The motion passed.
