TOWN COUNCIL MEETING MINUTES  

NOVEMBER 16, 2020

6:30 PM  

  


PRESENT:  Mayor Glenn Levy, Mayor Pro Tem Chelsea Steen, Councilmembers Kathleen Bailey, Mladenka “Mia” Boehrer, Sean R. Davis, and Melissa Jacobi.

STAFF MEMBERS PRESENT:  Sarah Albright, Town Clerk/Treasurer; Gene Bird, Public Works Director; Steve Davis, Chief of Police

1) CALL TO ORDER AND ROLL CALL
Mayor Pro Tem Chelsea Steen called the meeting to order, and Town Clerk/Treasurer Sarah Albright called the roll. 

Roll Call:  Bailey-- Yes, Boehrer--Yes, Davis--Yes, Ellsworth--Yes, Jacobi--Yes, Steen--Yes.  A quorum was present.  

2)  CONSENT AGENDA 
Councilmember Bailey moved and Councilmember Boehrer seconded to approve the items on the consent agenda as amended:

Summary Account Information & Accounts Payable for October 2020
Finance Committee and the meeting minutes for September 21, 2020.

Councilmember Bailey asked to have corrections made to the minutes for September 21, 2020, by removing her from the motions. 

Roll Call Vote: Bailey-- Yes, Boehrer--Yes, Davis--Yes, Ellsworth--Yes, Jacobi--Yes, Steen--Yes.  The motion passed.  

3)  UNSCHEDULED PUBLIC COMMENTS-COMMENTS ARE LIMITED TO 3 MINUTES
Mayor Pro Tem Chelsea Steen asked if there were any unscheduled comments from the public.  There were none. 

4)  STAFF UPDATES AND REPORTS
Reports on the Town’s departmental operations were given:

Public Safety – Chief Davis stated that the Police Department has been shut down due to two positive COVID tests.  The Department is receiving assistance from other agencies to help with the policing of the Town of Mountain View.  The Police Department will reopen at 6am tomorrow morning.  

Public Works— Mr. Bird referred to his report in the Town Council Agenda Packet by giving a brief update to his report.    

Town Attorney— No Report 

5)  PUBLIC COMMENTS REGARDING CURRENT AGENDA ITEMS
Mayor Pro Tem Chelsea Steen asked if the public had any comments regarding current agenda items.  

Lisa Maurath, a resident on Ames Street, addressed the Council.  

6) SECOND READING OF ORDINANCE NO. 2020-10-19B, AN ORDINANCE REPEALING AND REENACTING ARTICLE XIII OF TITLE 16 OF THE MOUNTAIN VIEW MUNICIPAL CODE CONCERNING THE REGULATION OF WIRELESS COMMUNICATION FACILITIES
 Mayor Pro Tem Chelsea Steen reviewed Ordinance No. 2020-10-19B, an ordinance repealing and reenacting Article XIII of Title 16 of the Mountain View Municipal Code concerning the regulation of wireless communication facilities.  

Councilmember Bailey moved and Councilmember Boehrer seconded to approve the second reading of Ordinance No. 2020-10-19B.  

Roll Call Vote: Bailey-- Yes, Boehrer--Yes, Davis--Yes, Ellsworth--Yes, Jacobi--Yes, Steen--Yes.  The motion passed.  

7)  SECOND READING OF ORDINANCE NO. 2020-10-19C, AN ORDINACE ADOPTING A BUDGET SUMMARIZING REVENUES AND EXPENDITURES FOR THE TOWN OF MOUNTAIN VIEW FOR THE CALENDAR YEAR COMMENCING JANUARY 1, 2021 AND ENDING DECEMBER 31, 2021, AND APPROPRIATING FUNDS THEREFOR
Mayor Pro Tem Chelsea Steen reviewed Ordinance 2020-10-19C, adopting a Budget summarizing revenues and expenditures for the Town of Mountain View.  There were three changes made to the second reading:     
- The Beautification line item increased to $15,000.00.
- The Air Quality line item for $100.00 moved to the General Fund.
- IT Services increased to $25,000.00.   

Councilmember Bailey moved and Councilmember Davis seconded to approve Ordinance No. 2020-10-19C as amended.  

Roll Call Vote: Bailey-- Yes, Boehrer--Yes, Davis--Yes, Ellsworth--Yes, Jacobi--Yes, Steen--Yes.  The motion passed.  

8) DISCUSSION AND POSSIBLE APPROVAL OF ORDINANCE NO. 2020-11-16A, AN ORDINANCE AMENDING ARTICLE 5 OF CHAPTER 2 AND SECTION 8-14-80 OF THE MOUNTAIN VIEW MUNICIPAL CODE RELATING TO COLLECTING FEES FOR MUNICIPAL AND TRAFFIC OFFENSES
Mayor Pro Tem Chelsea Steen asked Attorney King to review the proposed amendments to Ordinance No. 2020-11-16A.  Attorney King discussed the amendments to Article 5 of Chapter 2 to the Mountain View Municipal Code relating to collecting fees for Municipal and Traffic Offenses.  

Councilmember Ellsworth moved and Councilmember Jacobi seconded the approval of Ordinance No. 2020-11-16A as amended.  

Roll Call Vote: Bailey-- Yes, Boehrer--Yes, Davis--Yes, Ellsworth--Yes, Jacobi--Yes, Steen--Yes.  The motion passed.  

9) DISCUSSION AND POSSIBLE APPROVAL OF ORDINANCE NO. 2020-11-16B, AN ORDINANCE AMENDING SECTION 10-9-40 AND CHAPTER 6 OF THE MOUNTAIN VIEW MUNICIPAL CODE RELATING TO TOBACCO PRODUCTS
Mayor Pro Tem Chelsea Steen asked Attorney King to review Ordinance No. 2020-11-16B with Council.  Attorney King described the amendments contained in the ordinance.  

Councilmember Boehrer moved and Councilmember Ellsworth seconded the approval of Ordinance No. 2020-11-16B as amended.  

Roll Call Vote: Bailey-- Yes, Boehrer--Yes, Davis--Yes, Ellsworth--Yes, Jacobi--Yes, Steen--Yes.  The motion passed.  

 10) DISCUSSION AND POSSIBLE APPROVAL OF RESOLUTION NO. 2020-11-16A, A RESOLUTION APPROVING THE FIRST AMENDMENT TO THE INTERGOVERNMENTAL AGREEMENT WITH JEFFERSON COUNTY FOR CARES ACT LOCAL GOVERNMENT DISTRIBUTIONS
Mayor Pro Tem Chelsea Steen asked Attorney King to review Resolution No. 2020-11-16A with the Council.  Attorney King described the contents of the resolution.    

Councilmember Ellsworth moved and Councilmember Bailey seconded the approval of Resolution No. 2020-11-16A.   

Roll Call Vote: Bailey-- Yes, Boehrer--Yes, Davis--Yes, Ellsworth--Yes, Jacobi--Yes, Steen--Yes.  The motion passed.   

11) DISCUSSION AND POSSIBLE APPROVAL OF RESOLUTION NO. 2020-11-16B, A RESOLUTION INCREASING TRASH COLLECTION FEES FOR RESIDENTIAL AND COMMERCIAL PROPERTIES FOR 2021
Mayor Pro Tem Chelsea Steen reviewed Resolution No. 2020-11-16B, which increases trash collection fees for residential and commercial properties for 2021.  Discussion ensued.   

Councilmember Boehrer moved and Councilmember Ellsworth seconded to approve Resolution No. 2020-11-16B increasing trash collection fees as amended.    

Roll Call Vote: Bailey-- Yes, Boehrer--Yes, Davis--Yes, Ellsworth--Yes, Jacobi--Yes, Steen--Yes.  The motion passed.   

12) BREAK IN SESSION
Mayor Pro Tem Chelsea Steen suspended the meeting for a Break from 7:30pm to 7:50pm.  

13) DISCUSSION AND POSSIBLE APPROVAL OF RESOLUTION NO. 2020-11-16C, A RESOLUTION INCREASING THE SEWER TAP CONNECTION FEES FOR SINGLE FAMILY EQUIVALENT AND DUPLEX EQUIVALENT RESIDENCES AND INCREASING THE SEWER TREATMENT FEE AND MAINTENANCE FEE FOR RESIDENTIAL USERS
Mayor Pro Tem Chelsea Steen reviewed Resolution No. 2020-11-16C.  This Resolution increases the sewer tap connection fees for Single Family equivalent and Duplex equivalent residences and increases the Sewer Treatment fee and Maintenance fee for residential users.  

Councilmember Boehrer moved and Councilmember Ellsworth seconded the approval of Resolution No. 2020-11-16C.    

Roll Call Vote: Bailey-- Yes, Boehrer--Yes, Davis--Yes, Ellsworth--Yes, Jacobi--Yes, Steen--Yes.  The motion passed.   

14) DISCUSSION AND PROPOSED MODIFICATION TO ACCESSORY DWELLING UNIT SQUARE FOOTAGE LIMITS
Mayor Pro Tem Chelsea Steen introduced Matthew Nilsen of SAFEbuilt who gave a presentation on the proposed modification to accessory dwelling unit square footage limits.  Discussion ensued.    

15)  COMMITTEE UPDATES
Economic Development—The zoning map will be completed at the end of November.  

Finance Committee—The committee referred to its report in the Agenda Packet. 

CDOC Committee—The committee referred to its report in the Agenda Packet and updated the Council on the upcoming events and the newsletter.  

Administration— No report.  

Public Safety—No report.  

Public Works—The committee referred to its report in the Agenda Packet.  

Sustainability Committee—The committee referred to its report in the Agenda Packet and updated Council on the trash cleanup.  

16)  MAYOR’S REPORT/ITEMS
Mayor Pro Tem Chelsea Steen discussed concerns about trash in the alleys.  Mayor Pro Tem Steen asked for a vote of the Councilmembers to put this on the agenda as a discussion item for the next Council meeting.  The vote passed.  

17)  COUNCIL MEMBERS’ REPORTS/ITEMS  
No reports were given.

18)  MEETING TO ADJOURN
Councilmember Bailey moved and Councilmember Boehrer seconded the motion to adjourn the meeting at 8:30pm.
