PRESENT: Mayor Glenn Levy, Councilmembers Mladenka “Mia” Boehrer, Sean R. Davis, Abby Laib, Brittany Loecher, and Brent Metz.  
ABSENT (EXCUSED): Councilmember Kathleen Bailey
STAFF MEMBERS PRESENT: Gene Bird, Public Works Director; Steve Davis, Chief of Police
OTHERS PRESENT: Evin King, Hoffmann, Parker, Wilson & Carberry P.C., Town Attorney; Travis Reynolds, Town Planner

1) CALL TO ORDER AND ROLL CALL
Mayor Levy called the meeting to order, and Town Attorney Evin King called the roll. 

 Boehrer—Yes; Davis—Yes; Laib—Yes; Loecher—Yes; Metz--Yes.  A quorum was present.   

2)  CONSENT AGENDA 
Councilmember Metz moved and Councilmember Boehrer seconded to approve the items on the consent agenda:

Meeting Minutes for May 27, 2021, Regular Meeting.

Boehrer—Yes; Davis—Yes; Laib—Yes; Loecher—Yes; Metz--Yes.  The motion passed.  

3)  UNSCHEDULED PUBLIC COMMENTS-COMMENTS ARE LIMITED TO 3 MINUTES
Mayor Levy asked if there were any unscheduled comments from the public.  There were none. 

4)  STAFF UPDATES AND REPORTS
Reports on the Town’s departmental operations were given:

Public Safety – Chief Davis referred to his report in the Agenda Packet by pointing out the Police Department statistics for the last month.  Chief Davis stated that he had to write a report on the tragic shooting in Arvada which took place that morning.  Several Councilmembers extended their sympathy.  
Public Works—Gene Bird referred to his report in the Agenda Packet and asked if Council had any questions.  No questions were asked.  

Town Attorney— No Report 

5)  PUBLIC COMMENTS REGARDING CURRENT AGENDA ITEMS
Mayor Levy asked if the public had any comments regarding current agenda items.  There were none. 

6)  DISCUSSION AND POSSIBLE APPROVAL OF RESOLUTION NO. 2021-06-21, A RESOLUTION APPOINTING THE MAYOR PRO TEM FOR THE TOWN OF MOUNTAIN VIEW
Mayor Levy explained to the new Councilmembers the duties that are required of the Mayor Pro Tem.  Mayor Levy asked the Council for nominations for the open Mayor Pro Tem position.  Several Councilmembers nominated Sean R. Davis for the Mayor Pro Tem position.  Mayor Levy asked if there were any other nominations.  There were none.  

Councilmember Boehrer moved and Councilmember Loecher seconded the approval of Resolution No. 2021-06-21 appointing Sean R. Davis as Mayor Pro Tem for the Town of Mountain View.  

Boehrer—Yes; Davis—Yes; Laib—Yes; Loecher—Yes; Metz--Yes.  The motion passed.  

7)  DISCUSSION AND POSSIBLE APPROVAL OF ORDINANCE NO. 2021-06-21A, AN ORDINANCE AMENDING CHAPTER 16 OF THE MOUNTAIN VIEW MUNICIPAL CODE RELATING TO HEIGHTS OF RESIDENTIAL DWELLINGS IN THE R-2 AND R-3 ZONING DISTRICTS
Mayor Levy explained (and Councilmember Metz reiterated) that Councilmember Metz had a conflict of interest on Ordinance 2021-06-21A pertaining to R-3 residential district.  Levy stated that Council can split the Ordinance into two different ordinances--1) R-2 District and 2) R-3 District--if Council would like all members to be able to discuss and vote on one ordinance.  Council agreed to split the ordinance into two separate ordinances. 

Councilmember Boehrer moved and Councilmember Laib seconded to approve splitting Ordinance No. 2021-06-21A into 2 Ordinances: 1) R-2 height 2) R-3 height.  

Boehrer—Yes; Davis—Yes; Laib—Yes; Loecher—Yes; Metz—Recused from voting due to conflict.  The motion passed.  

 Discussion ensued about the first ordinance (2021-06-21A). Town Planner Travis Reynolds gave a detailed explanation about the height options for residential construction and how it was determined to recommend that height limits be set at 34 feet due to the high-water table in the Town and the community desire to promote traditional building styles.  Levy asked the planner about requiring an inspection during residential construction to verify that the building height did not exceed what is allowed in the code.  Reynolds stated that could be done administratively. Council discussed whether they thought Councilmember Metz had a conflict for the R-2 ordinance: The council determined they didn’t have a problem with Councilmember Metz discussing and voting on the R-2 height Ordinance No. 2021-06-21A.Councilmembers Metz and Loecher spoke against changing the established, current residential building height for the R-2 district.  Brief discussion on Ordinance No. 2021-06-21A ensued. 

Councilmember Boehrer moved and Councilmember Laib seconded the approval of Ordinance No. 2021-06-21A.  

Boehrer—No; Davis—No; Laib—No; Loecher—No; Metz--No.  The motion failed.  

Brief discussion ensued on Ordinance No. 2021-06-21B (new ordinance created by split—R-3 height)

Councilmember Davis moved and Councilmember Laib seconded the approval of Resolution No. 2021-06-21B.  

Boehrer—No; Davis—No; Laib—No; Loecher—No; Metz—Did not vote: Recused due to conflict of interest.  The motion failed.  

Mayor Levy suspended the meeting for a 10-minute break.

Mayor Levy swore in Councilmember Sean R. Davis as Mayor Pro Tem.  

8) NEW COUNCILMEMBER ORIENTATION DISCUSSION
Town Attorney Evin King reviewed with Council the organizational structure of the Town of Mountain View, ethics rules, attendance requirements, the Colorado Open Meeting Law, the rules for executive sessions, and other topics.  

9) PICNIC PLANNING UPDATE
Mayor Levy introduced the topic and Councilmembers Boehrer, Metz, and Loecher discussed the community picnic scheduled for August 21, 2021.  The Councilmembers spoke about including families and kids.  Councilmember Loecher asked the Attorney about potential kid-friendly events.  Councilmember Metz asked about having alcohol at the event, and the Attorney explained that offering alcohol would require a special permit and that comes with conditions.  

Multiple Councilmembers agreed on the main features of the picnic, including music and the Fiesta theme.  Mayor Levy clarified the budget for the event.  

10)  COMMITTEE UPDATES
Mayor Levy presented the updates that were in the packet.  There were no questions or comments.  

11)  MAYOR’S REPORT/ITEMS
Mayor Levy explained that he has been working on a grant proposal over the last year with Public Works Director Bird and that the town has received preliminary approval for a grant of $600,000.00 from DOLA to do curb and gutter work.  Levy explained that this grant money is contingent on DOLA getting federal funds and on the town completing all the remaining paperwork and an environmental assessment to the satisfaction of DOLA.  

Mayor Levy mentioned that Jefferson County is getting ready to approve the reverter language reversion on a portion of the Town Hall property which will (among other things) clear the way for a future Town Hall expansion--including a community meeting room for the town residents.  In addition, the Mayor discussed the updating of the Town’s website, and noting the replacement of an outdated Wordpress site.  He stated that staff will be able to keep the site  updated and add features.  Mayor Levy stated that the provider has an accessibility department and reviews all sites before they are released.  

Levy discussed the upcoming Colorado Municipal League convention and mentioned the Town will pay for Council Members to attend.  He ended his report by stating that he will make committee selections before the next meeting on July 19, 2021, and announce them then.  

12)  COUNCIL MEMBERS’ REPORTS/ITEMS

13) COUNCIL TO GO INTO EXECUTIVE SESSION PURSUANT TO C.R.S. 24-6-402 
Councilmember Metz moved and Councilmember Boehrer seconded to go into executive session for the discussion of a personnel matter under C.R.S. Section 24-6-402(4)(f)(I).  This executive session does not involve discussion of any specific employee that has requested discussion of the matter or any member of this council; any elected official; the appointment of any person to fill an office of this body or of an elected official; or personnel matters that do not require discussion of matters personal to particular employees regarding the Town Attorney.  

Boehrer—Yes; Davis—Yes; Laib—Yes; Loecher—Yes; Metz--Yes.  The motion passed.  

The Council met in executive session.

Councilmember Boehrer moved and Councilmembers Laib seconded to reconvene to regular meeting.

14) MEETING TO ADJOURN
Councilmember Boehrer moved and Councilmembers Metz seconded the motion to adjourn the meeting at 9:55pm.
